GCG, DBM AND CSC ISSUE JOINT CIRCULAR ON NIGHT-SHIFT DIFFERENTIAL PAY FOR GOVERNMENT WORKERS 

The Civil Service Commission (CSC), the Department of Budget and Management (DBM) and the Governance Commission for GOCCs (GCG), on 01 August 2023, signed a Joint Circular on the Rules and Regulations on the Grant of Night Shift Different Pay for government employees. 

The DBM and the GCG are mandated by law to administer the Compensation and Position Classification System (CPCS) in the government pursuant to Presidential Decree No. 985 (A Decree Revising the Position Classification and Compensation Systems in the National Government, and Integrating the Same) as amended, and Republic Act (R.A.) No. 10149 (GOCC Governance Act of 2011), respectively, which include the grant of night shift differential pay. Relative thereto, the CSC deemed it necessary to issue a circular disseminating R.A. No. 11701 and its Implementing Rules and Regulations (IRR) jointly with DBM and GCG. 

Present during the signing ceremony are Civil Service Chairperson Atty. Karlo Alexei B. Nograles, Budget and Management Secretary Amenah F. Pangandaman, and Governance Commission for GOCCs Chairperson Justice Alex L. Quiroz (ret.) together with GCG Commissioners Atty. Gideon Mortel and Atty. Geraldine Berberabe-Martinez and Budget Undersecretary Wilford Will L. Wong. 

The Joint Circular covers all government employees occupying positions from Division Chief and below, or their equivalent, in the executive, legislative and judicial branches, State Universities and Colleges (SUCs), Local Government Units (LGUs) and constitutional bodies, including those in GOCCs with original charters. 

Excluded from the coverage are those whose regular schedule of work fall between 6:00 AM and 6:00 PM, those whose services are required, or are on call, twenty-four (24) hours a day and others similarly situated as may be determined by the CSC, DBM, and GCG, and those engaged through Job Orders (JOs), Contract of Service (CoS), or other similar schemes covered by other related issuances. 

The Joint Circular pegged the maximum rate of night shift differential pay at twenty percent (20%). For Public Health Workers, the rate of night shift differential pay shall not be lower than ten percent (10%). The determination of the necessity for rendering services during the night shift shall be based on the nature of the services being provided. 

“Providing proper compensation is a fundamental human right. The enactment of R.A. 11701, which institutionalizes the grant of Night Shift Differential pay in the public sector is a welcome development para sa ating mga Kawani ng GobyernoIsa sa mga direktiba ng ating Pangulong Ferdinand R. Marcos, Jr. ay pangalagaan ang kapakanan ng sambayanang manggagawa sa bansa,”Chairperson Quiroz said. 

“It is a much-deserved benefit for employees heavily relied upon by the government to keep its operations running beyond the ordinary operating hours,” he added. 

The Joint Circular is a product of the collaborative efforts of the GCG, DBM AND CSC to harmonize and standardize existing rules and regulations pertaining to the grant of night shift differential pay to ensure uniform interpretation and effective and efficient implementation of the policy. 

The Governance Commission remains steadfast in its mandate as the central advisory, oversight, and monitoring body for GOCCs, to institutionalize transparency, accountability, financial viability, and responsiveness in corporate governance by monitoring and evaluating the performance of GOCCs.
